			<content:encoded><![CDATA[<p>&#8220;Facebook&#8217;s open invitation in a newspaper advertisement last week seeking applicants &#8220;to work in the US&#8221; is being regarded as a first,&#8221; according to <a href="http://economictimes.indiatimes.com/news/news-by-industry/jobs/facebook-hires-software-engineers-from-india-to-fill-us-posts/articleshow/12433245.cms">India&#8217;s Economic Times</a>. &#8220;The advertisement in The Times of India pointed applicants to an online coding challenge for 86 open positions in software engineering in Chicago, Dublin (Ireland), New York and Seattle. Those who solved the puzzles were promised a phone interview.&#8221;</p>
<p>It&#8217;s clear that if Americans want a job at Facebook they should start reading the Times of India and make sure to mask their US IP address so they can get a crack at US jobs.</p>
<p>In any case, the contest has ended and these 86 software engineering positions are nowhere to be found on <a href="http://www.facebook.com/careers/locations">Facebook&#8217;s recruiting site</a>.  There are <a href="http://www.facebook.com/careers/department?dept=chicago">no software engineering positions in Chicago</a> currently open, only 10 positions <a href="http://www.facebook.com/careers/department?dept=new-york">currently open in New York</a> and only <a href="http://www.facebook.com/careers/department?dept=seattle">19 positions in Seattle</a>.  In Dublin, there are 86 positions open; none are software engineers.  Most require language proficiency in Danish, Dutch, Arabic, Russian, Polish, Swedish, Norwegian, French, German, Czech, and Italian.</p>
<p>So where are these jobs?  They are in Facebook&#8217;s 3rd &amp; 4th quarter projections for 2012 and 2013!</p>
<p>You see, Facebook is in the midst of preparing a list of US job openings they want to fill with citizens from other countries.  This is the first step in the corporate program called H1-b.  The first day to submit this list to the Department of Labor is Monday, April 2nd. These H1-b filings submitted to the DOL for Fiscal Year 2013 cover hiring dates between Oct.1, 2012 through Sept. 30, 2013.  So these jobs won&#8217;t be created until the late this year.</p>
<p>Americans should be getting the first crack at job openings in the US, but current US law allows Facebook to recruit abroad first&#8211;and file for corporate visas under the H1-b program for these positions coming on-line 6-18 months from now.</p>
<p>Since Facebook is well-known for discriminating against older Americans, Blacks, Hispanics, and females, along with refusing to show their EEO data to the San Jose Mercury, I can only assume this recruiting strategy is erecting hiring obstacles for young, white techies under 30.  This is the new Evil.</p>

</strong><strong> </strong>A financial institution, Fidelity is an IRS tax processor and holds many state contracts.  They advertised &#8220;Walk-in for Immediate Joinee&#8221; in Chennai, India.  They are preferring B1 visa holders who can immediately  &#8220;travel for 3-5 months.&#8221;  Fidelity is sending this new hire to the US next week.  Euphemistically called &#8220;knowledge transfer&#8221; in the want ad, it means Americans must train them. Without US workers training these new recruits, the company can&#8217;t outsource the job.</p>
<p>Could this be why Fidelity <em>no longer</em> posts their job openings at Indeed.com, as the above graph shows?</p>

This company posted a notice on an Indian job board with the title, &#8220;Open House H1 (sic) Opportunity &#8211; Chennai&#8221; in Chennai, India.  They are looking for candidates with minimum 5 years of experience stating,  &#8220;We  have multiple positions open for US under H1 sponsorship.&#8221;  Their ad further states, &#8220;Candidates with valid US visa H1 may be  considered for immediate opening for US operations.&#8221;</p>
<p><strong>Digital-X is headquartered in Sunnyvale, California, USA, with offices in North Carolina (federal contractor)</strong><br />
This company is hosting a recruitment drive in late April;  three days in Bangalore and one day in New Delhi for &#8220;Software  Engineers for H1-b Visa Sponsorship &#8211; 10 Openings&#8221;.  They are looking  for candidates with<em> m</em>inimum 6 years of hard core technical  experience stating, &#8220;We are inviting applications for the H1B visa  filing for the year 2011 for a long term and permanent employment in  USA&#8221;.</p>
<p><strong>We will never put Americans back to work when we must fly to India to apply for a job that&#8217;s right in our own home town.</strong><br />

<p>There was a newly released paper Ron Hira also quoted from , created by the GAO (Government Accountability Office) and authored  by:</p>
<p>Andrew Sherrill &#8211; Director of Education,workforce and income security</p>

<p>This is an excellent paper titled &#8220;Multifaceted challenges Warrant Re-examination of Key Provisions&#8221;. They highlight,along with other points, that for the protection of US workers,  there is absolutely no visibility to the number of H1B&#8217;s which hides the truth about the Pink Elephant in the room that we all know is there!!!! (The Pink Elephant also has riding on top an unspecified number of L1s and B1s also which compounds the situation!!!)</p>
<p>The corporate shills Bo Cooper and Bruce Morrison(representing the corporate parts of IEEE-USA here) seemed to be asked the most questions and also seem to interject the most on other questions that were not directed to them. Is this appropriate I don&#8217;t know. Bo cooper represents employer that have/are being investigated by the USCIS for SERIOUS abuses of these visas, so not exactly a neutral source when it comes to any needed unbiased opinion on the need for more of these visas and more immigration!</p>
<p>Bruce Morrission helped draw up and enact this evil bill (the H-1B act in 1990) that we have seen destroy many of our current career paths. He expresses recently his &#8220;regret&#8221; at how staffing companies have abused this visa but I have it on good authority that this was part of his intention all along!!!!! Based on the staffing companies abusing this visa  exploding in just the last 10 years or so, I&#8217;m not so sure about this but I will look at the evidence I have just been provided.</p>
<p>Don Neufeld from USCIS stated what the facts about the 21% fraud and what they have done to try and enforce the laws they have been given to apply. He seems to think they are effective when asked!!! Well not from where I was/am now sitting!!!!! He was extremely neutral and literally just stated facts. He also when asked to work with the Dept of labor on enforcement of prevailing wage laws said that was not within his jurisdiction!!!! That in a nutshell is the problem!!(please read the GAO report that details the 4 government bodies who do not communicate that could kill this fraud if they did!!!)</p>
<p>I did not get a great feeling from those in attendance as to how they felt things had gone, but I did speak to both Ron Hira and Dr Gene Nelson who also has very eloquently described the incredibly unpatriotic act that is the H-1B and how it has been , in his considered opinion, designed for this very purposes, despite all protests by Bruce Morrison upset by how &#8220;staffing companies&#8221; have abused it!!!!</p>
<p>I was encouraged by the following congressmen and women who at least seemed to be starting to understand the level of fraud and displacement of US workers this H-1B program and L1/B1 fraud are causing:</p>
<p>Sheila Jackson Lee<a title="Sheila Jackson Lee" href="http://jacksonlee.house.gov/" target="_blank"> </a>- (congresswoman for Texas)  said there was a great need to protect the US workers and also how much &#8220;knowledge Transfer&#8221; is happening to be taken out of the country and used against us. I met with Ms. Jackson Lee later that day by chance and discussed with her the displacement of US workers and the level of fraud being committed. She seemed very concerned by this and has been hearing this a lot lately. Anybody living in Texas PLEASE contact her and let her know what you have seen, are seeing at your company/clients. You don&#8217;t have to mention the companies!</p>
<p>Dennis Ross (New congressman for Florida) &#8211;  intellectual property being given away , leaving the country and taking THE entire operation overseas!!!  (THAT IS WHAT THIS PROGRAM IS ENABLING!!!!)</p>
<p>Steve King &#8211; stated that we should not focus on the H-1B but on the bigger picture of the impact to the country. He says too much immigration IS driving down wages!!!!  We should concentrate on what helps boost the social and economic wellbeing of All Americans (i.e. Corporation are NOT the only americans!!!! There&#8217;s a concept!!!!) Immigrants (And guest workers)_ are taking upo all the growth in jobs so there is none left for U.S. citizens to grow into</p>
<p>Louie Gohmert &#8211; stated thousands of H-1Bs giving to citizens from countries of concern (no kidding!!!). What is being done to make sure these people are vetted properly. Also when they come her, are they restricted from certain control projects (well nope they are not. H-1Bs are working/did work for the Orlando Water board thru a contracting agency. Ya really think they check to see if he was from a country of concern????</p>
<p>Mr. John  Conyers &#8211;  scorned on Bo cooper when he mentioned that H-1B could &#8220;squawk&#8221;  on their slavemasters to the D.O.L. &#8220;Please!&#8221;" Conyers replied sarcastically to which some of us clapped!!!!</p>
<p>Mr. Trey Gowdy &#8211; asked Ron Hira what top three things could be done to immediately stop this fraud and also is the intent of the law being applied. Ron missed the perfect opportunity to mention the Durbin/Grassley act S.887 that would restrict &#8220;staffing companies &#8221; from having any non US citizens on a client site for work and would also have to comprise at least 50% US citizens and green card holders in their American registered company subsidiary . This would literally kill the American operations and eventually the Indian operations of TATA, Wipro, Infosys, Cognizant, HC (all rather heavily reliant on US offshoring) and seriously damaging those lovable consulting firms Deloitte (massive users of L1s and H-1B) and Accenture . (awwww diddums!!!! <img src='http://brightfuturejobs.com/wp-includes/images/smilies/icon_wink.gif' alt=';)' class='wp-smiley' />  )</p>
<p>I will be contacting each sub-committee member I saw speak and ask questions at the hearing (except Lamar Smith and Zoe Lofgren as the term &#8220;pissing in the wind&#8221; come to mind!!!!!) So if I get anything meaningful back I will post it here.</p>
<p>I do intend to go back to congress and become very familiar with my local politicians as well as any politicians who have influence over this subject. We all need to do this. We can change this but we have to be visible and start speaking to them. Please follow my lead and make a difference.</p>

			<content:encoded><![CDATA[<p>I had my first &#8220;real world&#8221; experience with how the H1B program is being administered by congress in a meeting held in congress titled &#8220;H-1B  Visas : Designing a program to Meet the Needs of the U.S. Economy and U.S. Workers&#8221;.</p>
<p>Designing???? After 21 years of being executed. it is completely obvious to me and everyone of my peers in the I.T. world with any knowledge that there is NO DESIGN to meet the need of the U.S. worker. There never was!!!!!! The only design was to follow through with the Alan Greenspan think-alikes&#8217;  masterplan of lowering the wages of skilled white collar I.T. workers who he and his cohorts felt (and still do!) are overpaid! </p>
<p>This meeting was held by the Subcommittee for Immigration And Enforcement and was a very full meeting , attended by a few people such as myself and Dr. gene Nelson, who know the real truth of how this program and others like it such as the L1 are decimating the current and future prospects of existing and future US citizens within Science and Technology , but also by a large portion of what looked like lobbyists (they almost smell different!) , along with other congressional aides.</p>
<p>My opinion was that, despite the attempt of Zoe Lofgren, a well publicized long-term advocate of this criminally abused program , I did get the feeling that there were quite a few congressmen who did get that the abuse and fraud within this program and the impact to US citizens is significant!! Whether they were doing lip service for their constituents but not really wanting this fraud stopped I don&#8217;t know as yet., but I will be investigating each and every participant to check their voting record and quoted opinions.</p>
<p>The chairman(Elton Gallegly)  and committee members spoke first before the testifiers who represented both those for and against the program as it stands. Unfortunately, the only person out of the four speaking against this ridiculously fraudulent program was :</p>
<p>Ron Hira &#8211; Associate professor of public policy for Rochester I.O.T.</p>
<p>Of the other 3 testifiers:</p>
<p>Donald Neufeld &#8211; An Associate Director for USCIS<br />
Bo Cooper &#8211; Partner for Berry Appleman &#038; Leiden LLP (employer shill)<br />
Bruce A. Morrisson &#8211; Chairman Morrission public affairs group.</p>
<p>The chairman ( Elton Gallegly)  seemed to give a lot of deference to Zoe Lofgren who spent a substantial amount of time talking both before and after the testifiers, giving her usual spiel but ironically enough ADMITTING now that the H-1B creates unfair competition!!!! Now that she is on the crusade for instant green-cards for students , she now admitted:</p>
<p>1. the H1B created unfair competition for the the US workforce.<br />
2. she was &#8220;shocked&#8221; that even though the average wage for a Silicon valley programmer is 92k , the average for H-1B workers was 52K. Shocked I tell ya <img src='http://brightfuturejobs.com/wp-includes/images/smilies/icon_wink.gif' alt=';)' class='wp-smiley' />   She kept asking questions to her Green-card cronies er…i mean , green card advocates, Bo Cooper and Bruce Morrison and conveniently ignoring asking any questions bar one to Ron Hira about the fraud.</p>
<p>Apart form this , Ms. Lofgren AGAIN brought up this loss of our &#8220;Best &#038; Brightest&#8221; foreign workers while conveniently (deliberately) ignoring the impact to the existing and very real US STEM workers (except in what may be an accidental slip up when trying to promote the unlimited green-cards for foreign student as mentioned in bullet point 1 above!!! I Wonder if she realizes that!!!!!)</p>
<p>She may also want to see the adverts for Job fairs held by U.S. companies ONLY IN INDA!!!! not the U.S., not Europe!!!  (please see: http://brightfuturejobs.com/recruiting-drive-for-us-jobs-open-house-for-h1-opportunity-chennai/ )</p>
<p>Ron Hira was very eloquent in his testimony about the H-1B that it needs a &#8220;serious overhaul&#8221;. Yeah, haul over a cliff!!!!!! He made some very damning comments that should be the death Knell of ANY program with such devastatingly contradicting evidence than the officially declared requirement:</p>
<p>1. Employers are LEGALLY displacing US workers with this program (and others such as L1)<br />
2. they are helping foreign competitors by enabling this &#8220;outsourcing visa&#8221;<br />
3. the term &#8216;Knowledge transfer&#8221; has been coined for taking this knowledge offshore.<br />
4. according to the GAO, 54%  of LCA&#8217;s (application applied for before H1b can be filed) were for the ENTRY LEVEL jobs. Get that??? ENTRY LEVEL!!! ARGHHHHHHHHH!!!!!!!!!<br />
5. Dept. of Labor has certified wages as low as $12.25 per hr for H1B computer professionals!!!!  U.S. citizens median is 70K .  Those prevailing wages are really working!!!!!!!<br />
6. H1B DO NOT lead to green cards. He cited Tata applied for approx. 2400 H1Bs between 2007-2009. ZERO green card applications!!!!!! roughly 2% of H1Bs get green card sponsorship which completely and utterly refutes ALL comments that the H1B leads to productive US citizens!!!!!</p>
<p>My next post will have details of what I observed with the other participants in this hearing.</p>

Technical Experience:   <strong>Minimum 5 years of hard core technical experience </strong>in developing/supporting complex enterprise applications in one or more of the skills listed below with strong academic credentials:</p>

·         Java – J2EE, HTML, JSP, AJAX, JavaScript, WebLogic / WebSphere (WSAD- Web-sphere Integration Developer tool kit, and WSRR &#8211; Web-sphere Registry Repository, experience), Web 2.0 technologies, FrontPage, Google Took Kit, and Yahoo UI Library<br />
·         Content Management: Oracle Universal Content Management, Stellent with strong Java development background,<br />
·         Oracle Fusion platform: BPEL, ADF (Web Center Suite), Oracle ODI (Oracle Data Integrator), BAM (Business Activity Monitoring), OBIEE, Hyperion.<br />
·         Portals: WebLogic Portal and WebSphere portal technologies.<br />
·         Database Developers/Administrators- Strong SQL Server development skills with SSAS, SSRS, SSIS on SQL Server 2005/2008, SQL Server production support. <p style="text-align: left;">So why is JP Morgan recruiting abroad to fill a US job opening that&#8217;s obviously entry-level?  I suspect that this worker must come to the US to be trained before they can do the job in India.</p>

In 2009, the <a href=" http://www.ajc.com/news/university-system-wont-furlough-115217.html">University of Georgia</a> announced furloughs for all citizen and green card employees, but&#8230;</p>
<p>&#8220;When employees of the University System of Georgia take their mandated  furlough days, foreign workers with a special visa will not be joining  them.</p>
<p>University System officials said placing these employees on unpaid leave  would require approval from the federal government. About 750 of the  system’s 40,000 employees have an H-1B non-immigrant visa, which allows  employers to temporarily hire foreign workers in specialty areas.</p>
<p>According to U.S. Department of Labor rules, an employee with the visa  who is furloughed still must be paid by the employer, who can seek a  waiver.&#8221;</p>
<p>H1-b  law provides great labor protections for foreign citizens&#8211;on paper.   But on paper, it&#8217;s horrible for US citizens and green card holders  because it allows companies to legally recruit abroad only for their US  job openings.</p>
<p>Because of the superior protections afforded H1-b  workers in comparison to US workers, American companies will often lay  off Americans before h1-b workers.</p>
<p><strong>Indian bodyshops, which are  temp staffing agencies, ignore these protections.</strong> They don&#8217;t pay their  H1-b workers when they are furloughed, called &#8220;benched&#8221; in the  industry.  They force Indian techies to pay visa fees before they get  the job, force them to sign bond contracts which give up their right to  leave the company without paying monetary damages.</p>
<p>Lacking  government oversight and auditing,  <a rel="nofollow" href="http://economictimes.indiatimes.com/news/news-by-industry/services/travel/visa-power/New-emigration-law-coming-employers-will-have-to-register/articleshow/5681738.cms" target="_blank">I</a>ndian bodyshops have brought third world labor standards to the US.  A  regressive social contract is being planted firmly in our cubicles. The  routine intimidation faced by Indian techies from their bosses has now  been <a rel="nofollow" href="http://www.nytimes.com/external/idg/2009/12/29/29idg-court-orders-three-h-1b-sites-disabled-83602.html" target="_blank">aimed at American techies</a>, with the spreading buckshot threatening the <a rel="nofollow" href="http://www.eff.org/deeplinks/2010/01/order-shut-down-websites-critical-apex-technology-" target="_blank">privacy and internet freedom</a> of every American.</p></blockquote>
